癌逝自殺傻傻分不清　仲介擺烏龍判解約

【許淑惠／台中報導】台中市劉姓女子今年1月幫兒子購屋，仲介告知16年前屋內有人因憂鬱症殺炭自殺，但送醫後才身亡，並於買賣契約中勾選該建物「曾發生凶殺或自殺致死」，劉女不以為意簽約給付訂金150萬。

事後，劉女聽鄰居說該屋屋主9年前在屋內上吊身亡，劉女以仲介隻自未提此事，兒子不願入住為由，要求解除買賣契約，仲介和池姓賣家稱根本不知9年前還有上吊一事，況且已告知有人燒炭是「凶宅」。
 
台中地院傳喚原屋主，才知仲介資訊錯誤搞烏龍，16年前是女主人癌症去世，並非燒炭，9年前則是男主人被逼債上吊自殺，法院指出，賣家須負瑕疵擔保責任，雖然仲介已告知是「凶宅」，但是資訊錯誤仍屬未盡告知義務，判決雙方買賣契約解除，賣家要返還150萬元訂金。
